These Terms & Conditions apply to your use of this website and to any products you buy from Auto Labs Performance Centre (“Auto Labs”, “we”, “us”, “our”), owned and operated by James Garzia, Factory 18/99 Bald Hill Rd, Pakenham VIC 3810. By placing an order you agree to these terms. Please read them alongside our Privacy Policy, Returns & Refunds Policy and Shipping Policy.
Orders
When you place an order you’re making an offer to buy. We’ll confirm your order by email, but a contract is only formed once we accept and dispatch it. We may decline or cancel an order — for example if an item is out of stock, there’s a pricing or description error, or we can’t verify your details — and if we do, we’ll refund anything you’ve paid for that order.
Pricing & GST
- All prices are in Australian dollars (AUD) and include GST where applicable.
- Shipping is calculated and shown separately at checkout before you pay.
- We try to keep pricing accurate, but if an error occurs we’ll let you know before processing your order and give you the choice to continue at the correct price or cancel for a full refund.
Payment
Payment is processed securely by Shopify through its hosted checkout. We don’t collect or store your card details. See our Privacy Policy for more.
Fitment & product compatibility
Many of our products are vehicle-specific parts. It’s your responsibility to confirm a part suits your vehicle — including make, model, year, engine and transmission — before ordering. If you’re not sure, contact James before you buy and he’ll help you get the right part. This does not affect your rights if a product is faulty or not as described (see below).
Your rights under the Australian Consumer Law
Our goods come with guarantees that cannot be excluded under the Australian Consumer Law. You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. You are also entitled to have the goods repaired or replaced if the goods fail to be of acceptable quality and the failure does not amount to a major failure.
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law. Where the law allows us to limit our liability, our liability is limited to replacing the goods, supplying equivalent goods, or paying the cost of doing so.
Returns & refunds
Returns and refunds are covered by our Returns & Refunds Policy, which forms part of these terms.
Product descriptions & images
We take care to describe and photograph products accurately, but minor variations in appearance can occur and screens display colour differently. If a product arrives materially different from its description, your consumer guarantee rights apply.
Intellectual property
The content on this website — text, images, logos and branding — belongs to Auto Labs Performance Centre or is used with permission, and may not be copied or reused without our consent.
Governing law
These terms are governed by the laws of Victoria, Australia, and any dispute will be handled by the courts of Victoria.
Changes to these terms
We may update these Terms & Conditions from time to time. The version that applies to your order is the one published on this page when you place it.
